Terms & Conditions of Hire/Charter for the vessel "DIZZY".
- INTRODUCTION.
The following sets out the terms and conditions under which the vessel "DIZZY" may be chartered. This document forms an agreement between "DIZZY" (the owner) and the company or individual hiring the vessel (the charterer’s).
- THE VESSEL.
The owner will make available the vessel "DIZZY", licensed, insured and carrying regulation safety equipment, as set out in the MCA Code of Practice for small commercial vessels. The vessel will also carry a licensed skipper & a crew when appropriate.
- ACCOMMODATION.
Accommodation must be reserved directly by the charterer's with the Guesthouse or Hotel at the destination etc and as such "DIZZY" are not involved in reservation of rooms etc.
- PAYMENT.
A deposit is required to secure a booking. This is normally £250 for a daily charter. For a single charter, the balance is due on commencement of the charter. For multiple charters, the full amount is payable on commencement of each trip; the deposit is taken into account and deducted from thefinal charter. The price quoted may be subject to a variable fuel surcharge should the price of diesel increase substantially. You will be advised of this should this circumstance occur.
For Charters of several days a larger deposit will be required. This is subject to the skippers discretion but will normally be 25% of the total charter.
- SIZE OF PARTY.
Our license restricts us to a maximum of 10 passengers plus two crew. These limits will not be exceeded under any circumstances. If you find that your party is depleted, let us know in good time & we will try to help you make up the numbers. Please remember that the charter cost is for the boat & the charterer's are responsible for the full fee, regardless of how many people are on board.
- WEATHER.
Our single biggest problem.
For single day charters, please call us on Mobile (07785) 277521 on the evening prior to the trip to check conditions.
We acquire weather information from a number of sources; shipping forecast, inshore forecast, internet buoy data, TV etc., and use it in deciding whether or not to sail. Intelligent interpretation of the best data available does not guarantee a correct decision; the owner cannot be held responsible if the charterer's have a wasted journey as weather conditions are liable to change.
- CANCELLATION.
- If the owner cancels the charter due to adverse weather conditions, problems with the boat, illness or indisposition on the owner's part or skipper's part, no boat charter fee is payable & the full deposit is returnable.
- If deteriorating weather conditions force an early return to port, only that portion of the trip spent at sea is chargeable, with any part of an hour counting as 1 hour. It is the discretion of the skipper if no charge is levied.
- A decision to return early to port is the skipper's & his alone. A return at the insistence of the passengers qualifies as a complete trip & the full fee is payable.
- If the charterer's cancel a trip within 4 weeks of its date of departure, the deposit is forfeited. If such cancellation is within 2 weeks of the charter date, the entire fee is payable. These conditions are only to apply if the owner is unable to secure an alternative charter on the date in question.
